Plan424 Terms of Service

We've tried to make our terms of service as straightforward and fair as possible. When reading these, please keep in mind two things:

  1. When a major disaster is occurring, phone and internet services may be unavailable. The key feature of Plan424 should still work — copies of plans should be cached on users' phones — but it's unrealistic to expect every feature to continue to work in the middle of a major earthquake…
  2. Nobody can provide you with simple advice which will always be appropriate in every conceivable circumstance. There are always exceptions…

Plan424 No Nonsense Terms of Service

  1. This is a legal agreement between "you", the service user and Albion Research Ltd ("we" or "us").
  2. The software and services we provide are on an “as is” basis. We don't guarantee anything, and we and our suppliers aren't liable if anything doesn't work, or causes you any direct, indirect, special, incidental, or consequential damages whatsoever.
  3. You agree that any services supplied by us or our suppliers may not always be available.
  4. The pre-written plans we supply are of a general nature and may not be suitable in any specific situation. You agree that you will verify that any plan or advice supplied by us is suitable or is adapted to meet your needs, and you will make sure your end users are aware that general advice may not apply to a specific situation.
  5. You will keep any passwords supplied by us confidential, and not disclose them to any third parties.
  6. You must not reverse engineer our software or services unless your local laws explicitly give you that right.
  7. We retain the copyright to all plan or other content created by us. If this agreement is terminated, you must stop using our copyrighted material.
  8. This contract can be terminated by either party at any time.
  9. If you terminate the contract, no refund will be given for any partial months of service. If you made an annual prepayment, we will refund you for any unused months based upon the non-discounted monthly fee. (For example, if you pre-paid $2,500 on the 1st January and the normal monthly fee was $250, then if you canceled in March you would be charged $750 for three months service at $250, and receive a refund of $1,750).
  10. If we terminate the contract, we will refund you for a pro-rated amount based upon the date we terminate your service. In this situation annual prepayments will be pro-rated until the date of service termination.
  11. In the event of any claim by you arising out of this agreement, you agree that it will be settled by a mutually acceptable arbitrator. You also agree that this agreement is governed by the laws of the Province of Ontario, Canada, and that any damages awarded will be limited to the amount of your last payment for goods or services. If you have not yet made any payment, then the amount shall be limited to $1.00.
  12. We can update these terms of service by giving you one month's notice of the revised terms. If you do not wish to accept the change, you will inform us in writing before the end of the notice period. Otherwise, you agree that you will be deemed to have accepted the revised terms of service.
